Terms of service

These terms are the agreement between you and Kevon Knight, doing business as Mindfall ("we", "us"), for using Mindfall at mindfall.app. By using Mindfall you agree to them. They're written to be read — if anything's unclear, ask us at [mnmncoda@gmail.com](mailto:mnmncoda@gmail.com).

Using Mindfall

Mindfall is free to use: the sounds, the scenes, the modes and a selection of stories. You can use it without an account. You're welcome to use it for yourself and your household; please don't copy, resell or redistribute its sounds, stories, pictures or code, or try to break or overload the service.

Your account

You're responsible for your account and for keeping access to your email. Give a real email you can receive codes at. You can delete your account at any time from the app (You → Your data).

What's yours

Your journal pages, the names you give your scenes, and anything else you write in Mindfall are yours. We only keep them to run Mindfall for you, as described in the privacy policy.

What's ours

Mindfall's sounds, scenes, artwork, stories, recordings and software belong to us or to the people who license them to us (some recordings and paintings are public domain, credited where they appear). Using Mindfall doesn't give you ownership of them.

Mindfall Plus

Plus is an optional subscription that unlocks the whole story library and other extras listed in the app.

• Prices and periods are shown before you subscribe (monthly or yearly). Taxes may be added where required.
• Renewal: a subscription renews automatically at the end of each period until you cancel.
• Cancelling: you can cancel at any time; Plus stays active until the end of the period you've paid for, and won't renew.
• Refunds: if something's gone wrong, write to us — we'll be fair. Where the law in your country gives you a right to a refund or to withdraw, that right applies.
• Changes in price apply from your next renewal, and we'll tell you before they do.

Payments are handled by Stripe; we never see your card details.

Not medical advice

Mindfall is for relaxation and rest. It isn't a medical device or a treatment, and nothing in it is medical advice. If you have trouble sleeping, or with anxiety or your health, please talk to a doctor. Don't use Mindfall while driving or doing anything that needs your full attention, and keep the volume at a level that's comfortable and safe for your hearing.

The service, as it is

We work hard to keep Mindfall running well, but it's provided "as is": we can't promise it will always be available or free of errors, and features may change. As far as the law allows, we aren't liable for indirect losses, and our total liability to you is limited to what you've paid us in the twelve months before the claim. Nothing in these terms limits rights you have under the law of your country that can't be limited.

Ending

You can stop using Mindfall and delete your account at any time. We may suspend accounts that break these terms or harm the service or other people.

Changes to these terms

If we change these terms in a way that matters, we'll say so in the app or on the blog before the change takes effect. Using Mindfall after that means you accept the new terms.

Law

These terms are governed by the laws of the State of Georgia, USA, without prejudice to the protections of the law of your own country.
